Regulations of the FEST Fan Tix

<h2>Rules for purchasing “FEST FAN TIX” tickets for Fest Festival 2022:</h2>
1. The FEST Fan Tix Ticket is a personal four-day pass (entitling you to enter the Event on any day of its duration).

2. FEST Fan Tix Tickets are sold only in the form of Electronic Tickets.

3. Each customer may purchase a maximum of 5 (five) FEST Fan Tix tickets, supplementing the personal data of persons who intend to use them. In the event that the tickets have been supplemented several times with the personal data of the same person, the person who has the FEST Fan Tix ticket supplemented with the personal data of the Customer who purchased the FEST Fan Tix ticket is obliged to simultaneously enter the Event with the Customer whose personal data are included in the ticket.

4. After the payment for the tickets has been made and the transaction is completed at the same time, the data with which the FEST Fan Tix Ticket has been supplemented cannot be changed.
<h3>REFUND:</h3>
5. The customer has the right to return a personal FEST FAN TIX ticket up to 60 days before the festival’s start date, ie by June 12, 2022. To make a return, the customer should contact the Promoters via e-mail by sending the returned personal FEST electronic ticket Fan Tix before the above-mentioned deadline.

6. If the customer returns the ticket on the terms described in the point above, the Promoter charges a fee for returning the ticket in the amount of PLN 100 for each returned ticket and will refund the Customer the correspondingly reduced amount in the same way as the method of payment by the Customer.

7. After the deadline referred to in sec. 6 above, the Customer loses the right to return the tickets on the terms described in these regulations. At the same time, the Promoter informs that pursuant to Art. 38 point 12 of the Act, the Customer (including the Consumer) is not entitled to withdraw from the contract for the purchase of an Electronic Ticket (“The right to withdraw from a contract concluded outside the business premises or at a distance is not available to the consumer in relation to contracts for the provision of accommodation services, other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service provision “- art. 38 point 12 of the Act).

<h2>TERMS AND CONDITIONS OF PURCHASING “FEST FAN TIX” TICKETS.</h2>
<strong>Definitions:</strong>
The following capitalized terms will have the following meaning in these Regulations:

<strong>Promoter</strong> – means the company Fest Festival Sp. z o.o. with headquarters in Warsaw (00-375), at ul. Smolna 38, entered into the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw under the KRS number 0000766893, with the NIP number 5252777162.

<strong>Ticket Distributor</strong>- a legal person or a natural person running their own business, authorized by the Promoter to sell, change and return tickets on the basis of the Fest Festival Sp. z o.o.

<strong>Price</strong> – means the price of the Electronic Ticket placed on the Website. The prices are given in Polish zlotys and include VAT (they are gross prices).

<strong>Consumer</strong> – means a natural person who is a user of the Website and performs a legal transaction with the Ticket Distributor not directly related to his business or professional activity.

<strong>Entrepreneur</strong> – means a natural person, legal person or organizational unit referred to in art. 43 (1) of the Civil Code, which is a user of the Website.

<strong>Client</strong> – means the Consumer and the Entrepreneur treated jointly.

<strong>Website</strong> – means the website www.festfestival.pl, through which the Customer has the right to purchase an Electronic Ticket using outside the network of stationary points.
<strong>Numer zamówienia</strong> – oznacza unikalny numer nadawany przez Serwis przy zamawianiu Biletu elektronicznego.

<strong>Electronic ticket</strong> – means a ticket generated in the Website’s IT system, authorizing, after its printing, to enter the Event after meeting the conditions set out in these Regulations and the regulations of individual Events. The electronic ticket shall be delivered by the Ticket Distributor to the Customer by e-mail.

<strong>Event</strong>- means a service in the field of entertainment, including outdoor entertainment, including concerts, festivals, music or dance and music performances, etc.

<strong>Act</strong> – means the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827 as amended).

<strong>The amount due </strong>- this is the amount that the Customer should finally pay after successfully placing the Ticket order. The amount consists of the price of the Ticket, the service fee and the possible cost of invoice shipping according to the option chosen by the Customer.

<strong>Service fee</strong> – a fee due for the Customer’s use of the System on the Website in the amount of the indicated% of the sum of the prices of the Tickets ordered.

<strong> §1 General rules: </strong>

1. The Website is intended for Consumers and Entrepreneurs who want to purchase an Electronic Ticket via the Internet for Events organized by the Promoter. People who want to purchase a ticket for the Event in the form of a traditional document, paying for it on delivery in cash, by credit card or by credit card, should go to the nearest stationary points.

2. The use of the Website requires the following technical conditions:
– connection to the Internet (wired or wireless),
– a web browser enabling access to the content of the Website,
– enabling cookies in the web browser.

3. By purchasing a ticket through the Website, the Customer agrees to purchase tickets on the terms set out in the “Ticket Purchase Regulations” and “Going Application Use Regulations.” issued by the Ticket Distributor, i.e. the company <strong> GOING Limited Liability Company </strong> with its registered office in Warsaw, address: ul. Szymczaka 3/36, 01-227 Warsaw, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000588000, the registration files of which are kept at the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, REGON: 363058596, NIP : 5272751272, e-mail: support@goingapp.pl.

<strong> §2 The rules for purchasing “FEST FAN TIX” tickets for the Fest Festival: </strong>

1. In the case of a Fest Festival Event, the Promoter offers the Website the option to purchase a FEST Fan Tix ticket on special terms described below.

2. The FEST Fan Tix ticket is a personal four-day pass (entitling you to enter the Event on any day of its duration).

3. FEST Fan Tix Tickets are sold only in the form of Electronic Tickets.

4. Each customer may purchase a maximum of 5 (five) FEST Fan Tix tickets, supplementing the personal data of persons who intend to use them. 8. After the deadline referred to in sec. 6 above, the Customer loses the right to return the tickets on the terms described in these regulations. At the same time, the Promoter informs that pursuant to Art. 38 point 12 of the Act, the Customer (including the Consumer) is not entitled to withdraw from the contract for the purchase of an Electronic Ticket (“The right to withdraw from a contract concluded outside the business premises or at a distance is not available to the consumer in relation to contracts for the provision of accommodation services, other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service provision “- art. 38 point 12 of the Act).

9. The dates of the availability of FEST Fan Tix tickets are announced on the Website.

10. The number of tickets available in the FEST Fan Tix offer is limited.

11. The return is made within 14 days from the date of notification.

<strong> §3 Complaints and Final provisions: </strong>

1. The consumer may contact the Promoter via e-mail to the address tickets@followthestep.com, by post, by sending correspondence to the address of Fest Festivla Sp. z o.o., ul. Smolna 38/1, 00-375 Warsaw.

2. The consumer has the right to lodge a complaint in the form of written correspondence sent to the address indicated in paragraph 1 above. Complaints may be submitted immediately after finding the circumstances justifying their submission. The consumer should, if possible, provide the Promoter with all information and documents regarding the complaint that may be helpful in recognizing it. The Promoter should consider the complaint immediately, no later than within 30 days from the date of its delivery.

3. The Entrepreneur has the right to submit a written complaint by registered mail to the Promoter’s address indicated in section 1 above. Complaints may be submitted immediately after finding the circumstances justifying their submission. The Client (Entrepreneur) should, if possible, provide the Promoter with all information and documents regarding the complaint that may be helpful in recognizing it. The Promoter should consider the complaint no later than within 60 days.

4. The regulations of individual Events and additional regulations for the purchase of tickets for individual Events are available on the Website and on the Organiser’s website and may contain additional important information and procedural differences. In the event of discrepancies between the aforementioned documents, the Regulations of the Event and the regulations for the purchase of tickets for individual Events shall prevail.

5. These Regulations are available on the Website.

6. The Promoter reserves the right to change the Regulations. Amendments to the Regulations are announced on the Website. The consumer is bound by the regulations accepted when making the purchase (ordering) of the Electronic Ticket.
